| Terms: | We are confident you will enjoy your bidding and buying experience through our online auction site. This requires you understanding your responsibilities as a buyer. Before registering to bid, please read the following and download our Complete Terms of Sale here.
- Registration Deposit. We will authorize your credit card for $100 as an Auction Registration deposit. This authorization will place a 3-7 day hold on these funds with your credit card company, but will not be charged unless purchases are made. Upon Buyers’ successful award of bid, Buyer shall be immediately responsible for 25% of their purchases as a non-refundable deposit. Auctioneer may charge or authorize Buyers’ credit card or make other arrangements for deposit in a cash form; however, Auctioneer’s election not to collect the 25% does not waive Buyers’ obligation to the such amount in the event of default.
- Buyer’s Premium. A 15% Buyer’s premium will be added to the price of each item you purchase.
- Payment. We will process your payment upon the close of the auction using the credit card provided. You will receive an invoice by email. If you suspect you purchased something and did not receive an email, please contact us asap. You also have the option of making payment by Cash or Cashiers’ Check, provided that you NOTIFY US BY EMAIL PRIOR TO THE CLOSE OF THE AUCTION.
- Taxes. You are responsible to pay sales tax unless you are in the business of reselling your purchases and you provide to us a faxed copy of your signed resale certificate PRIOR TO THE CLOSE OF THE AUCTION. Sales tax will not be charged on titled vehicles, as it is the buyer's responsibility to pay such tax directly to the dmv.
- Bidding. Once you submit your bids, you can select the ‘Review Bids’ button at any time to review and increase your bids. You cannot delete a bid once it has been placed. Please confirm your bids for accuracy. You will receive outbid notices for bids placed prior to the day of the auction. On auction day, you must use the review bids function to confirm your bid status.
Once a reserve item reaches its reserve price, an indicator will appear that the item has met its reserve. Items that have met their reserve are confirmed as sold to the high bidder. In the event the reserve price is not met, Auctioneer will seek to obtain approval to sell the item at the high bid and inform the buyer within 24 hours of the sale. Please note that we reserve the right add to, group, withdraw or re-catalog items in this auction, as well as adjust minimum bids and/or reserve prices and extend or shorten closing times. - Removal of Items Purchased. YOU ARE SOLELY RESPONSIBLE TO REMOVE PURCHASES WITHIN THE TIMEFRAMES POSTED. IF YOU ARE UNABLE TO PICKUP YOUR PURCHASES IN THE ALLOTTED TIMEFRAMES, DO NOT BID AT THIS AUCTION...WE DO NOT OFFERING SHIPPING OR MOVING SERVICES. All purchases must be paid in full before your items will be released from the premises. You are also responsible to provide your own material handling equipment and packing supplies and to provide Auctioneer with a Certificate of Insurance. You or your pickup representative must provide the paid invoice at time of pickup.
In the event an item is unavailable at the time of pick-up, Buyer must immediately notify Auctioneer’s site representative, as well as send an email notification to Auctioneer within 24 hours. Auctioneer shall not be responsible for claims made after 24 hours. - Failure to Remove Purchases. In the event items are not removed in the timeframes allotted, the items purchased shall be deemed abandoned and you will lose any right, title or interest you may have acquired and the items shall revert and repossess to us without further notice to you. We will also be entitled to any costs associated with the removal, storage and reselling of your items, and any other charges, fees, and expenses we incur.
- Representations. We make every effort to provide accurate information about the items being sold. However, you are solely responsible to confirm the accuracy of items offered for sale. We encourage you to attend inspections, as descriptions and photos are offered as a guide only. In certain cases, a photo of like product may be used to represent several different lots. Photos may also capture nearby items not listed as part of the lot. Do not rely solely on photos to make buying decisions; be sure to read descriptions. Auctioneer shall not be held responsible for such errors as posting the wrong photo for an item. When in doubt about the condition of an item, please bid accordingly. .All items are sold ‘As-Is, Where-Is’.
- Failure to Pay. In the event you fail to pay the entire purchase price by the payment deadline, we may retain and/or recover, the Registration Deposit as liquidated damages, as well as any losses incurred by reselling the item, including storage, removal and resale related costs.
- All Sales are Final. A successful bid at auction, whether live or online, constitutes a legally binding contract of sale. All sales are final. There will be no refunds, returns or exchanges.
